By subscribing to our services or purchasing a consulting package, you agree to be fully bound by these Terms. If you do not agree, please do not use our services.

1. Services & Scope of Work

Aus4K Digital provides high-end IT services, network infrastructure consulting, and premium technical support.

• Deliverables: The specific scope of your speed optimization or infrastructure auditing is determined strictly by your active monthly subscription tier or a mutually agreed-upon independent service agreement.

• Service Delivery: All technical assistance, audits, and configuration adjustments are handled remotely by our engineering team.

2. Subscription Tiers & Billing

• Billing Cycle: All premium support memberships (Essential Core, Advanced Optimization, Elite Infrastructure, and Aus4K VIP Dedicated) are billed on a recurring monthly subscription basis.

• Price Adjustments: Aus4K Digital reserves the right to modify our service pricing or subscription tiers at any time. We will provide active clients with a minimum of 30 days’ written notice via email prior to any pricing changes taking effect.

3. Strict No-Refund Policy

• All Sales Are Final: Due to the immediate deployment of technical resources, automated server monitoring configurations, and dedicated consulting time required to set up and optimize your digital infrastructure, Aus4K Digital enforces a strict no-refund policy.

• No Prorated Credits: Upon canceling a subscription tier, your service will remain active until the end of your current paid billing cycle. No partial or prorated refunds will be issued for unused days within a billing period under any circumstances.

4. Client Responsibilities & Data Backups

• Data Backups: While our team takes extreme care when performing speed optimizations and routing adjustments, the client retains full, sole responsibility for maintaining comprehensive, independent backups of their website, databases, and server configurations. Aus4K Digital is not liable for data loss.

• Access Credentials: To perform our services, you may need to grant our engineers temporary administrative access to your website backend, DNS registry, or hosting server. You agree to provide secure, accurate credentials and revoke them promptly upon the completion of project work.

5. Prohibited Conduct & Support Fair Use

• Abuse Policy: We maintain a professional, corporate working environment. Any abusive, harassing, or threatening behavior directed toward our support staff or engineering team via email, ticketing, Slack, or WhatsApp will result in immediate service termination.

• Account Termination: In the event of service termination due to a violation of our conduct policy, your membership will be canceled immediately, and no refund will be issued for the remaining duration of the billing cycle.

6. Limitation of Liability & Warranties

• “As-Is” Provision: All technical advice, optimizations, and configurations are provided on an “as-is” and “as-available” basis.

• Third-Party Elements: While we optimize your digital infrastructure for maximum efficiency, Aus4K Digital cannot and does not guarantee 100% uninterrupted uptime or absolute immunity from third-party server failures, global routing outages, hosting provider downtime, or sophisticated cyber threats.

• Liability Cap: To the maximum extent permitted by applicable law, Aus4K Digital’s total liability for any claims arising from our services shall not exceed the total amount paid by the client to Aus4K Digital during the single month immediately preceding the claim.

7. Intellectual Property

All custom scripts, optimization protocols, documentation templates, and technical methodologies provided to you by Aus4K Digital remain the intellectual property of Aus4K Digital. You are granted a non-exclusive, non-transferable license to use these optimizations solely on your own designated digital platforms.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any legal actions or proceedings arising under these Terms shall be brought exclusively in the appropriate courts of Australia.
